The Supreme Court on Monday rejected a request by Peter Navarro, a former adviser to former President Donald Trump, to be released from prison while he appealed his four-month prison sentence for defying a House committee subpoena. who investigated the Capitol riot on January 6th.
The order denying Navarro’s request for release pending appeal said only that his request had been addressed to Judge Neil Gorsuch and forwarded to the court, which denied it.
It was the second time in six weeks that the Supreme Court has rejected Navarro’s efforts to suspend his prison sentence as he fights a guilty verdict on two counts of contempt of Congress.
Navarro, 74, surrendered to a federal prison in Miami on March 19 to begin serving his sentence.
Navarro was impeached after he refused to comply with a subpoena from the House special committee investigating the events of January 6, 2021, when a violent mob of Trump supporters stormed the US Capitol, temporarily delaying the transfer of power to President Joe Biden .
Navarro claimed the executive privilege doctrine prevented him from responding to the subpoena. But much of the information sought by the committee did not fall under executive privilege, and Trump did not assert executive privilege at all, U.S. Attorney General Elizabeth Prelogar noted in a brief filed with the Supreme Court in March.

She responded to Navarro’s March 15 request for the Supreme Court to release him pending an appeal of his conviction.
On March 18, Chief Justice John Roberts denied that request, writing in a brief opinion that he saw “no basis for disagreeing with lower court rulings” that Navarro “forfeited” executive privilege arguments. have. Roberts noted that the release process was “contrary to his pending appeal on the merits.”
On April 2, Navarro’s lawyers renewed his attempt to stop the order to go to prison, this time asking Gorsuch to comply with the request.
Attorneys noted that Navarro had already spent 15 days in jail at that point. They added that a federal appeals court in Washington, D.C., has set a briefing schedule for his appeal that is not scheduled to be completed until mid-July – after Navarro’s sentence is completed.
